Upcoming Supreme Court Ruling on Car Finance Commissions

The UK Supreme Court is set to announce a crucial decision regarding car finance commissions this Friday. This ruling has the potential to significantly impact major banks, possibly leading to a multibillion-pound compensation obligation.

Challenges from Major Lenders

Close Brothers, a British lender, along with South Africa’s FirstRand, is seeking to overturn a pivotal ruling from the Court of Appeal. This earlier judgment stated that brokers need to have fully informed consent from customers to receive commissions from lenders.

Industry Reactions and Financial Implications

The October 2024 ruling sparked substantial concern within the £40 billion motor finance sector, particularly affecting companies like Close Brothers and Lloyds. The stock prices of these institutions have been under pressure as a result.

To prepare for potential repercussions, Lloyds has set aside £1.15 billion, while Banco Santander’s UK branch has earmarked £290 million, and Barclays has allocated £95 million.

Regulatory Developments

The Financial Conduct Authority (FCA), which oversees the industry, is considering a redress scheme. Analysts predict that this could lead to massive costs for the banking sector, possibly reaching into the tens of billions.

The FCA has indicated it will decide on the implementation of the redress scheme within six weeks following the Supreme Court’s ruling.

Consumer Rights and Legal Arguments

In the ruling from October 2024, the Court of Appeal clarified that lenders are responsible to consumers when commissions are not disclosed adequately. This places a burden on lenders, as insufficient disclosure of commissions can result in liability.

During the Supreme Court appeal in April, the FCA’s lawyers contended that the Court of Appeal may have overreached, raising hopes among lenders that any potential financial consequences might be mitigated.

Broader Economic Considerations

The ramifications of this case are broader than just the financial sector. Reports suggest that UK finance minister Rachel Reeves might consider legislation that could shield lenders from hefty financial losses, which could, in turn, impact her goals for stimulating economic growth.

The Supreme Court is expected to deliver its ruling after 15:35 GMT on Friday, once the London financial markets have closed. The court has cautioned that no assumptions regarding the outcomes of the appeals should be made based on the timing of the announcement.
