BPO Challenges from New U.S. Legislative Proposals

Recent legislative proposals in the United States could present significant hurdles for Business Process Outsourcing (BPO) firms planning to establish operations in developing nations like South Africa.

Overview of Proposed Legislation

The “Keep Call Centres in America Act,” put forth by U.S. Senator Ruben Gallego, aims to deter companies from relocating call centres overseas and from integrating Artificial Intelligence (AI) into their operations.

This proposal emerges amid increasing interest from American firms, such as Concentrix and Amazon, which have recently opened BPO facilities in South Africa.

Economic Impact of BPO in South Africa

South Africa’s initiative to attract international BPO firms has yielded notable success, generating approximately R24 billion annually for the Western Cape economy, comparable to the tourism sector. Additionally, it has brought in around R3.6 billion in foreign direct investment (FDI).

The sector has made a substantial contribution to job creation, employing over 270,000 individuals across six cities, with around 65,000 catering to international clients.

Effects on International BPO Operations

The proposed legislation poses risks not only for South Africa’s BPO industry but also for hubs in India and the Philippines that have attracted offshore businesses.

If enacted, the bill would mandate U.S. companies setting up overseas call centres to inform the U.S. Department of Labor at least 120 days prior to relocation. The Department would maintain a public registry of these firms for five years.

Government Implications and Compliance

Companies listed as relocating their call centres would be disqualified from obtaining new government grants and guaranteed loans, while those not listed would be prioritized for government contracts.

Moreover, businesses would be required to document job losses attributed to AI implementations.

Future of the Proposed Legislation

The ultimate impact of this legislation on South Africa’s BPO sector remains uncertain, as it must first navigate through various committees in both the House of Representatives and Senate before gaining presidential approval.

Should it pass, companies would have a year to adjust before the measures take effect, but it’s unclear if there is sufficient support to advance the bill from committee stages.

Expert Opinions

Attorney Blake Landis noted in the National Law Review that it may take time before the proposed legislation becomes law. He mentioned, “Overall, the Keep Call Centers in America Act remains in the early stages of the legislative process.” The bill’s progress through committees and potential for wider congressional backing is still uncertain.

Landis also highlighted that discussions surrounding this legislation indicate a growing awareness among U.S. lawmakers regarding the influence of technology on consumers and the workforce. “We are seeing an increased focus on regulating the interplay of technology, labor, and consumer engagement,” he stated.
